These Terms of Service ("Terms") are a legally binding agreement between you ("you" or "your") and Hala Media Marketing Services VSM, a company registered in Dubai, United Arab Emirates, trading as travaloSIM ("travaloSIM", "we", "us" or "our"). These Terms govern your access to and use of the travaloSIM website, mobile application, and the eSIM data plans and related services we make available (together, the "Services").
1. Acceptance of Terms
By creating an account, purchasing a Plan, or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Refund Policy, each of which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not access or use the Services.
If you are using the Services on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Definitions
- "Plan" means a mobile data package (data allowance, geographic coverage, and validity period) made available for purchase through the Services.
- "eSIM" means the digital profile we provide that allows a Compatible Device to connect to a mobile network without a physical SIM card.
- "Activation" means the point at which an eSIM first registers onto a mobile network for use of a purchased Plan.
- "Compatible Device" means a device that supports eSIM technology and is unlocked from any other carrier, as further described in our device-compatibility resources.
- "Validity Period" means the number of days, starting from Activation (unless stated otherwise for a Plan), during which the data allowance for that Plan may be used.
- "Network Partners" means the third-party mobile network operators whose networks carry the data traffic for a given Plan.
3. Eligibility & Accounts
You must be at least 18 years old, or the age of legal majority in your jurisdiction, and have the legal capacity to enter into a binding contract, to use the Services. Some features require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@travalosim.com if you suspect any unauthorized use of your account.
4. Description of the Services
travaloSIM sells digital eSIM data Plans that provide mobile data connectivity in over 200 travel destinations through arrangements with third-party Network Partners. Unless a Plan expressly states otherwise, the Services are data-only and do not include voice calling, SMS, or access to emergency services.
The Services depend on the coverage, capacity, and performance of our Network Partners, which we do not own or operate. We do not guarantee uninterrupted, error-free, or specific-speed connectivity, and coverage may be affected by factors such as local infrastructure, network congestion, weather, and geography. We may add, remove, or change Network Partners, destinations, or Plan inclusions at any time without liability, provided we use reasonable efforts to maintain a comparable level of service for active Plans.
5. Orders, Pricing & Payment
Prices for Plans are displayed on our website or app and, unless stated otherwise, are shown in US Dollars or UAE Dirhams. Prices are exclusive of applicable taxes (including UAE VAT at the prevailing rate, currently 5%, and any equivalent tax in your country of billing) unless we state that tax is included. Taxes and any payment-processing surcharges will be added at checkout where applicable.
Payments are processed by third-party, PCI-compliant payment processors. We do not store your full card details. By making a purchase, you authorize us and our payment processors to charge your selected payment method for the applicable price, taxes, and fees. We reserve the right to refuse or cancel an order, including in cases of suspected fraud, pricing errors, or a breach of these Terms, in which case we will refund any amount already charged for the cancelled order.
6. Activation, Validity & Data Use
- Most Plans must be activated within 180 days of purchase. A Plan that is not activated within this window will expire, and you will not be entitled to a refund, except as set out in our Refund Policy.
- Once activated, your data allowance is available for use until the earlier of (a) the data allowance being fully consumed, or (b) the end of the Plan's Validity Period. Unused data is forfeited at the end of the Validity Period and does not roll over, unless a specific Plan states otherwise.
- You may purchase additional data ("top-ups") for a compatible, active Plan where this option is offered, at the price in effect at the time of purchase.
- We apply reasonable fair-use and anti-fraud measures to protect the integrity of the Services for all customers, including traffic-management controls and usage monitoring. We will tell you if a fair-use limit materially affects your Plan.
- Plans are intended for personal, non-commercial use during travel. You may not use a Plan to operate a SIM box, gateway, repeater, or any service that resells or redistributes connectivity to third parties without our prior written consent.
7. Device Compatibility
It is your responsibility to confirm, before purchase, that your device is a Compatible Device and is carrier-unlocked. We provide a device-compatibility checker and setup guides to help you do this. We are not liable for your inability to use a Plan due to an incompatible or locked device that you did not verify before purchase; however, our Refund Policy describes limited circumstances in which a refund may still be available.
8. Acceptable Use
You agree not to use the Services to: (a) violate any applicable law or regulation; (b) infringe the intellectual property, privacy, or other rights of any person; (c) transmit malware, spam, or unlawful, defamatory, or obscene content; (d) interfere with, disrupt, or impose an unreasonable load on our or our Network Partners' infrastructure; (e) attempt to gain unauthorized access to the Services or any related systems; or (f) reverse engineer, decompile, or attempt to extract the source code of our software, except as permitted by law. We may suspend or terminate the Services, with or without notice, where we reasonably believe these Terms have been violated.
9. Intellectual Property
The Services, including the travaloSIM name, logo, website, app, and all related content, software, and designs, are owned by or licensed to Hala Media Marketing Services VSM and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. You may not copy, modify, distribute, sell, or create derivative works based on the Services, in whole or in part, except as expressly permitted by these Terms.
10. Third-Party Services
The Services may link to or rely on third-party services, including payment processors, app stores, and Network Partners. We do not control and are not responsible for the content, policies, or practices of third parties. Your use of any third-party service is subject to that third party's own terms and policies.
11. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected, or that network coverage, speed, or quality will meet your expectations in any particular location.
12. Limitation of Liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.
Subject to the above, to the maximum extent permitted by applicable law: (a) we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunity, arising out of or related to your use of the Services; and (b) our total aggregate liability to you for any claim arising out of or relating to these Terms or the Services will not exceed the total amount you paid to us for the Plan(s) giving rise to the claim in the twelve (12) months preceding the event giving rise to the liability.
13. Indemnification
You agree to defend, indemnify, and hold harmless Hala Media Marketing Services VSM, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your breach of these Terms; (b) your misuse of the Services; or (c) your violation of any law or the rights of a third party.
14. Suspension & Termination
We may suspend or terminate your access to the Services, in whole or in part, at any time, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent or unlawful activity, or where required to do so by law or a Network Partner. You may stop using the Services at any time. Termination does not entitle you to a refund except as set out in our Refund Policy. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.
15. Refunds
Refunds, cancellations, and the statutory right of withdrawal applicable to certain purchases are governed by our Refund Policy, which forms part of these Terms.
16. Governing Law & Dispute Resolution
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the federal laws of the United Arab Emirates and the laws of the Emirate of Dubai, without regard to conflict-of-law principles. You agree that the courts of Dubai have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms, except where applicable consumer-protection law in your country of residence grants you the right to bring proceedings in your local courts, in which case that mandatory right is preserved.
17. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will provide at least 30 days' notice before the change takes effect, by posting a notice on our website or app, or by emailing you. Your continued use of the Services after a change takes effect constitutes acceptance of the updated Terms. If you do not agree to a material change, you may stop using the Services and, where applicable, request a pro-rata refund for any unused, unactivated Plan in accordance with our Refund Policy.
18. General Provisions
Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be replaced with one that most closely reflects its original intent.
Waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
Force Majeure. We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of god, network or internet outages, government action, or failures of our Network Partners.
Entire Agreement. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Services and supersede any prior agreements.
Notices. We may send notices to the email address associated with your account or by posting on our website or app.
